So…Those Virginia Updates…

A recurring theme within Virginia’s cannabis space these past several months has been, wait and see. The end results are (usually) positive, but they are certainly achieved at the last second possible!

The Latest

This was the case on April 13th, which was the absolute last day Governor Abigail Spanberger could do anything surrounding the cannabis legalization bill which was sent her way for her signature. As had become expected over the last week or so, the Governor announced two main amendments for SB542.

With amendments, the Assembly will now reconvene on April 22. They can either approve or reject these amendments and also have the power to override a veto from the Governor with a two-thirds majority vote. After passage of a revised bill, Spanberger has until May 25 to sign this.

The Changes

There are two significant amendment changes being request by the Governor. 

  1. Tax revenue distribution. This would see adjustments made to how cannabis tax revenue is allocated once the market is operational. 

  2. A delayed sales launch. This is not welcome news, but there could be some optimism to be found here. The Governor is proposing a retail sales launch date of July 1, 2027 as opposed to January 1, 2027. In a press statement, her office indicated that thus would help launch a safer legal market and allow for more time to combat the illicit market throughout Virginia. 

The Future

What this means moving forward is that, unfortunately, we have to be a bit patient. We do at least know that Spanberger is interested and invested in getting the program off the ground and running. A delayed start can also yield some positives.

A delayed start does allow for businesses to have more time to organize their finances, identify a property, build out a team, and it puts them on more equal footing with the preexisting medical operators. All hope is not yet lost in Virginia and if anything, we should be heartened that things are at least progressing in the right direction!
